RERA in Karnataka: What Homebuyers Need to Know ?

Karnataka RERA guide for homebuyers in Bengaluru

Introduction

If you are buying a home in Bengaluru, Karnataka RERA is your strongest legal protection. It makes developers register their projects, share their approvals and timelines openly, and pay you compensation if they delay your home.

Before RERA, many buyers in the state faced delayed possession, smaller flats than promised and money diverted to other projects. They had very little power to fight back. Karnataka RERA changed that by putting clear rules and a dedicated authority in place.

In this guide, we explain what Karnataka RERA is, which projects must register, the rights it gives you, how to check a project online, and how to file a complaint if something goes wrong.

What Is Karnataka RERA?

RERA stands for the Real Estate (Regulation and Development) Act, 2016. It is a central law passed by Parliament, and it came fully into force on 1 May 2017. Each state then made its own rules and set up its own authority.

K-RERA is the state’s version of this system. It has three parts:

PartWhat it is
The lawThe RERA Act, 2016, which applies across India
The state rulesThe Karnataka Real Estate (Regulation and Development) Rules, 2017, which set the fees, forms and interest rates for Karnataka
The authorityThe Karnataka Real Estate Regulatory Authority (K-RERA) in Bengaluru, which registers projects and hears complaints

Appeals against K-RERA orders go to the Karnataka Real Estate Appellate Tribunal.

All Karnataka RERA services are online on the official portal, rera.karnataka.gov.in. This includes project search, agent search, complaints and orders.

If you are new to RERA, start with our basic guide: What Is RERA? A Complete Guide for Homebuyers.

Which Projects Must Register Under Karnataka RERA?

Under the Act, a residential project must register with Karnataka RERA before the developer can advertise, market or sell it, if:

  • the land area is more than 500 sq m, or
  • the project has more than 8 apartments.

Ongoing projects that had not received a completion certificate when the law began also had to register. Plotted layouts and villa projects above these limits must register too.

A developer cannot legally take bookings for a project that needs registration but does not have it. If a builder says “RERA is coming soon” and still asks for a booking amount, treat it as a warning sign.

Real estate agents must register too

The law also covers property agents and channel partners. Every agent who helps sell a registered project must hold their own agent registration number.

Infantry Homes is a registered agent with Karnataka RERA (No. PRM/KA/RERA/1251/309/AG/190207/001291). Before you deal with any agent, ask for their Karnataka RERA number and check it on the portal.

7 Powerful Rights Karnataka RERA Gives Homebuyers

1. The right to full project information

The developer must upload the approved plans, layout, land title, completion date and quarterly progress updates on the K-RERA portal. You can see all of it before you pay anything.

2. The right to pay for carpet area only

Flats must be sold on carpet area, the actual usable space inside your walls. The developer cannot charge you for a vague “super built-up” figure without clearly stating the carpet area in the agreement.

3. A cap on the advance payment

A developer cannot take more than 10% of the flat’s cost as an advance before signing a registered agreement for sale with you.

4. Protection for your money

The developer must keep 70% of the money collected from buyers in a separate bank account, called an escrow account. It can be used only for land and construction of that project, not diverted to another project.

5. Compensation for delay

If the developer does not hand over possession by the date in your agreement, you can choose between two options:

  • Exit the project: get a full refund with interest.
  • Stay in the project: get interest for every month of delay until possession.

Under the Karnataka rules, this interest is the State Bank of India’s highest MCLR plus 2%.

6. Five years of protection for structural defects

If you find a structural defect or poor workmanship within 5 years of possession, the developer must fix it free of cost within 30 days.

7. No changes without your consent

The developer cannot change the approved plan or specifications of your flat without your consent. Major changes to the project need the consent of at least two-thirds of the buyers.

How to Check a Project on the Karnataka RERA Website

Checking a project takes less than 10 minutes. Do it before you pay any booking amount.

  1. Open the portal. Go to rera.karnataka.gov.in.
  2. Search for the project. Use the project search option and enter the project name, the developer’s name or the RERA registration number.
  3. Match the registration number. The number on the portal must match the one printed on the brochure, website and advertisements.
  4. Check the completion date. Compare the registered completion date against the possession date the sales team promises you. If they differ, trust the RERA date.
  5. Check the registration validity. Make sure the registration has not expired or lapsed.
  6. Read the quarterly updates. Developers must report construction progress every quarter. Missing or late updates are a warning sign.
  7. Download the documents. Look at the approved building plan, land title and other approvals uploaded by the developer.
  8. Look for complaints and orders. Check whether other buyers have filed complaints against this project or the developer’s other projects.

At Infantry Homes, we run this check on every project before we recommend it. Every home on our Projects page is registered with Karnataka RERA.

How to File a Complaint With Karnataka RERA

If your developer delays possession, changes the plan without consent or breaks the agreement, you can file a complaint with Karnataka RERA online. You do not need a lawyer, though one can help in complex cases.

  1. Write to the developer first. Send your complaint in writing, by email or registered post, and keep a copy of any reply.
  2. Register on the portal. Create a complainant account on the K-RERA website with your mobile number and email.
  3. Fill in the complaint form. Add the project details, the developer’s name and the relief you want: a refund, interest for delay or repairs.
  4. Upload your documents. Attach the sale agreement, payment receipts, allotment letter, emails and your ID proof.
  5. Pay the fee online. The filing fee for an individual complaint is about ₹1,000. Confirm the current amount on the portal before you pay.
  6. Attend the hearings. The authority will hear both sides, usually online or at the K-RERA office in Bengaluru.

The law asks the authority to decide complaints within 60 days, though many cases take longer. If you disagree with the order, you can appeal to the Karnataka Real Estate Appellate Tribunal, generally within 60 days of the order.

Penalties Under Karnataka RERA

The RERA Act gives the authority real power to punish developers and agents who break the rules.

ViolationMaximum penalty under the RERA Act
Developer sells without RERA registrationUp to 10% of the project cost
Developer keeps selling after a penalty for non-registrationUp to 3 years in jail, or a further 10% of the project cost, or both
Developer gives false information or breaks other rulesUp to 5% of the project cost
Developer ignores orders of the Appellate TribunalUp to 3 years in jail, or a further 10% of the project cost, or both
Agent works without registration₹10,000 per day, up to 5% of the property cost

These penalties are why reputed developers follow the rules closely. They are also why you should avoid any project or agent that is not registered.

Red Flags and the Limits of Karnataka RERA

Red flags to watch for

  • No RERA number in the advertisement. Every registered project must display its RERA number in ads and brochures.
  • “Pre-launch” booking pressure. A large booking before the project is registered is not protected by RERA.
  • Different possession dates. The sales team promises one date, but the portal shows a later one.
  • Lapsed registration. The registration has expired, and the developer has not applied for an extension.
  • Missing quarterly updates. The developer has stopped reporting progress on the portal.
  • Requests for more than 10% before the agreement. This breaks the RERA rules.

What Karnataka RERA does not cover

RERA is powerful, but it is not a complete safety net.

  • It does not cover small projects below 500 sq m or with 8 apartments or fewer.
  • It does not check the land title for you. You still need a lawyer to verify the title, e-Khata and encumbrance certificate.
  • It mainly protects buyers of new projects. Resale purchases from individual owners are largely outside RERA.

That is why a RERA number is the first check, not the last one. Read our guide to Common RERA Mistakes Homebuyers Should Avoid.
